It binds all lot owners and future buyers, and it covers lot use, building size, setbacks, fences, pets, parking, and other property standards. - Land use & building type: Lots are for single-family residential use only, with one detached dwelling (max 3 stories) and a private garage for up to two cars. Lots 3 and 3A allow one single-family home and one garage apartment. No commercial structures are allowed.
- Dwelling size: Each dwelling must have at least 1,000 heated square feet; basements, unfinished attics, storage, garages, porches, and other unenclosed areas don't count.
- Setbacks & trees: Buildings and garages must meet Asheville's current setback requirements. No trees may be planted or removed without prior approval from the developers.
- Fences & landscaping: Fences and walls require prior written approval; chain-link or metal fences are prohibited, and all fences must be wood and painted white. Lawns and landscaping must be maintained, and new landscaping (hedges, pools, etc.) needs developer approval.
- Accessory structures: No trailers, mobile homes, tents, sheds, treehouses, playhouses, outbuildings, storage units, carports, doghouses, or swimming pools may be built or moved onto a lot without express prior written approval.
- Parking & vehicles: No on-street parking for more than 24 hours. No wrecked, junked, or undriveable vehicles may be kept on the property. Boats, trailers, RVs, and similar items must be stored inside the garage. No vehicle repairs on the property except emergencies.
- Pets: No farm animals. Household pets are allowed but must be kept in enclosed areas (except cats). All cats and dogs must be neutered. Maximum of two dogs, two cats, or one of each per lot.
- Exterior appearance & maintenance: No clotheslines or exterior clothes hanging. Mailboxes must be provided by developers and kept in good repair. Satellite dishes are allowed, but outdoor antennas are not. Porches and patios must be kept neat; no inappropriate furniture or appliances stored outside. Exterior paint or siding color changes need prior approval.
