Tidal Walk is a planned community in Sea Breeze, NC, governed by a homeowners' association (HOA). This document is the Declaration of Covenants, Conditions and Restrictions for Phase 1, which applies to all property owners (owners of lots, home units, or townhome units). It establishes the HOA, common areas, assessments, and rules for the community.
- What you own & maintain: Owners own their lot and dwelling (home or townhome unit). The Association maintains common areas (including private streets, ponds, docks, pools, walkways, landscaping, and exterior maintenance of townhome units such as roofs and exterior walls). Owners are responsible for their own dwelling's exterior and landscaping up to the community roadway, and must keep their property neat and orderly.
- Assessments & fees: All units pay annual assessments, initially $2,400 per unit (2008), with annual increases capped at 10% without member vote. A working capital assessment equal to three months of annual assessments is due at closing from the first purchaser. Special assessments require a 2/3 vote of members. Delinquent assessments accrue 18% annual interest and can become a lien on the property.
- Voting rights: Each unit owner gets one vote per unit owned. The Declarant (developer) holds Class B membership with three votes per planned unit until 80% of units are sold or 25 years after recording, whichever comes first. The Declarant may create additional membership classes for boat slip owners or multifamily unit owners.
- Parking & vehicles: Off-street parking must be provided by each owner. On-street parking for personal vehicles is allowed subject to HOA rules. Boats, trailers, trucks, and commercial vehicles cannot be parked on streets or common areas unless stored in an enclosed garage or screened by approved landscaping.
- Architectural control: An Architectural Control Committee (ACC) oversees design and landscaping standards. Owners must maintain landscape buffers per ACC standards. The Association may enter a lot to perform maintenance if the owner fails to keep it neat, and charge the cost plus 15% to the owner.
- Common area use & restrictions: Owners have an easement to use common areas, but the Association can suspend use (except streets) for up to 60 days for rule violations. The Association may limit guests and require guests to be accompanied by a resident. Boat slips and docks may be developed, with separate assessments for those owners.
- Leasing & rentals: The document does not specify minimum lease terms or restrictions on rentals. Owners may delegate their common area use rights to tenants, family, guests, and invitees, subject to HOA rules.
