What Serenity's governing documents say
Serenity is a planned single-family home community in Buncombe County, NC, governed by a homeowners' association (HOA). This document is the full set of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners, residents, and their guests.
- What you own & maintain: You own your lot and the dwelling on it. You are responsible for all exterior maintenance and landscaping of your lot. The association maintains the common elements (roads, shared driveways, stormwater systems, landscaping, gate, signs, and common area amenities).
- Leasing & rentals: Leases must be for at least 7 consecutive days. Tenants must follow all HOA rules. The association can revoke an owner's right to rent after repeated violations. Guest houses may be rented separately only if leased for a year or more.
- Architectural review: All exterior changes (buildings, fences, landscaping, paint colors) require prior written approval from the Architectural Committee. New homes must be at least 1,500 sq. ft. of heated living area, no more than 3 stories, and completed within 12 months. A $150 review fee applies for construction plans.
- Pets & animals: Reasonable numbers of common household pets (dogs, cats) are allowed, but not for commercial purposes. Pets must be controlled, vaccinated, and waste must be disposed of. No livestock, poultry, or exotic animals. Pets cannot be tied outside or left unattended.
- Parking & vehicles: No unlicensed, inoperable, or uninsured vehicles may be parked outside. Boats, RVs, and trailers can only be stored in an enclosed garage or for up to 3 consecutive days. No parking on streets or common areas. No vehicle repairs outside except emergencies.
- Assessments & fees: Annual assessments start at $1,200 per lot (as of 2017) and are set annually by the board. A one-time $500 setup fee is paid at first closing. Special assessments may be levied for capital improvements (requires majority vote) or emergencies. Late payments accrue 8% interest and can become a lien on the property.
- Use restrictions: Lots are for single-family residential use only. No businesses, noxious activities, above-ground pools, outdoor clotheslines, or basketball goals protruding into streets. Hunting and discharging firearms are prohibited. Political signs allowed (max 24"x24") 45 days before an election, removed 7 days after.
- Enforcement & fines: The board can fine up to $100 per violation per day after notice and a hearing. Fines become a lien on the lot. The board can also suspend common area privileges and voting rights. The association may enter a lot to abate violations after 10 days' notice.
