What St James Plantation POA Inc's governing documents say
This is an amendment to the master declaration for St. James Plantation, a single-family home community in St. James, NC. It adds specific restrictions for Lot 1B, Section 5, binding all owners of that lot. The community is governed by a master declaration and an architectural control committee (ACC).
- Land use & home type: The lot is for single-family residential use only. No business or commercial activity is allowed. Mobile homes, manufactured homes, and modular homes are prohibited. Dwellings must have at least 2,000 heated square feet (up to 200 sq ft may be covered porch).
- Architectural review & construction: All improvements, alterations, and landscaping must be approved by the ACC before construction. Construction must be completed within 12 months of starting. Landscaping must be finished within 90 days of occupancy. No temporary structures (except during construction with ACC approval).
- Pets & animals: Only dogs, cats, or other household pets are allowed, not for commercial purposes, and must comply with all laws. No livestock or poultry.
- Parking & vehicles: Boats, trailers, RVs, commercial vehicles, and trucks larger than half-ton pickup cannot be parked visible from the street for more than 24 hours (unless fully enclosed in a garage). Inoperative or unlicensed vehicles also limited to 24 hours. Off-road vehicles (go carts, dirt bikes, ATVs) are prohibited except for construction or golf course use.
- Setbacks & easements: The ACC determines dwelling placement. Minimum setbacks are shown on the plat. Easements exist for drainage, utilities, and pathways along property lines (5 ft front/side, 5-10 ft rear, 15 ft from streets). Lakes and ponds have a 15 ft maintenance easement.
- Stormwater & environmental restrictions: Maximum built-up area (impervious surface) is 3,100 sq ft. A 30 ft vegetated buffer must be maintained between built-up areas and surface waters. No filling or altering of designated drainage swales. Wetlands are protected; no disturbance allowed without permits.
- Fences, signs, & antennas: Fences and walls require ACC approval. Signs are limited to name/address signs and temporary construction signs (ACC-approved). Outside antennas and satellite dishes are prohibited except as allowed by ACC design guidelines.

- No dwelling shall be erected or allowed to remain on any Lot if the dwelling does not contain at least 2,000 heated square feet; up to 200 square feet of this minimum may be provided by covered porches so long as the roof forms an integral (Section 4)
- Maintenance
- Owner responsible for maintaining Lot and improvements (Section 16). If lake/pond within Lot, owner responsible for maintaining edge, bank, erosion control (Section 19). Association may enforce and govern via ACC and Board. (Sections 16, 19, 26)
- Use restrictions
- The Lot shall be used for single-family residential purposes only. The operation of any business or commercial enterprise is expressly prohibited, except a temporary sales office/model with prior written consent of Brunswick Harbor. (Section 1)

- Combined Lots considered a single Lot for assessment and voting purposes per Master Declaration. Amendment requires affirmative vote or written consent of members representing two-thirds of total votes of each Type of Membership. (Sections 2, 25)
- Amendments
- Brunswick Harbor may unilaterally amend while it still owns any portion of the Development or Additional Property, so long as the amendment has no material adverse effect upon any substantive right of any Owner. Amendments required by state (Section 25)
