What The Towns at St. James Plantation's governing documents say
This is a supplemental declaration of covenants for Seaside Phase 1, a single-family home subdivision within the larger St. James Plantation master-planned community in St. James, NC. It adds specific rules for these lots on top of the master association's broader restrictions. The rules bind all lot owners and their successors.
- Land use & dwelling type: Lots are for single-family residential use only. No business or commercial activity is allowed, except a temporary sales office with developer consent. No mobile, manufactured, or modular homes are permitted.
- Minimum dwelling size: Each home must have at least 1,600 heated square feet. Up to 200 square feet of that minimum may come from covered porches that are part of the main roof line.
- Construction timeline: Construction must start within 90 days of lot purchase and be completed within 6 months. Landscaping must be finished within 90 days of occupancy. The Architectural Control Committee (ACC) may grant extensions.
- Architectural review: All improvements, alterations, and landscaping must be approved by the ACC before construction begins. The ACC also controls building location, setbacks, fences, walls, signs, and tree removal (no living tree 4 inches or larger in caliper may be cut without approval, except in approved building areas).
- Parking & vehicles: Boats, trailers, RVs, commercial vehicles, and trucks larger than a half-ton pickup may not be parked on a lot for more than 24 hours if visible from the street (unless fully enclosed in a garage). Inoperative or unlicensed vehicles are similarly restricted. Off-road vehicles (go carts, dirt bikes, ATVs) are prohibited except for construction or golf course use.
- Pets & animals: No livestock or poultry. Dogs, cats, and other household pets are allowed, but not for commercial purposes, and must comply with all applicable laws.
- Stormwater & environmental restrictions: Maximum built-upon area per lot is 4,500 square feet. A 30-foot vegetated buffer must be maintained between all built-upon area and surface waters. Altering drainage swales is prohibited. No potable water wells may be constructed. Wetlands are protected; any disturbance requires federal and state approvals.
