This is a supplemental declaration for Phase 13-A, Section 1 of SeaWatch at Sunset Harbor, a single-family home community in Bolivia, NC. It adds specific rules for these lots on top of the community's master declaration. The rules apply to homeowners and are enforced by the homeowners association and an architectural control committee.
- Land use & building type: Each homesite is for one detached single-family dwelling (max 35 ft height), a private garage (max 3 cars), porches, decks, patios, a pool, and one outbuilding. No modular, mobile, manufactured homes, or geodesic domes. No commercial use, but a temporary sales office is allowed with declarant's consent.
- Minimum dwelling size: Heated floor area minimums vary by lot: lots 1-18 and 162-179 require 1,800 sq ft; lots 19-26, 70-103, and 116-121 require 2,200 sq ft; lots 48-69 require 2,500 sq ft. Basements, garages, and one-story porches are excluded.
- Architectural review: All improvements and landscaping must be approved by the ACC. No living tree 4+ inches in diameter at 4 ft high, or any flowering tree/shrub, may be cut without ACC consent unless in a construction area. Construction must be completed within 12 months; landscaping within 60 days of occupancy. An application fee and construction bond may be required.
- Piers, docks & water access: Only homesites 51, 52, and 63 may have one dock or pier each. Piers on homesites 53-62 are subject to a separate shared walkway and pier easement. All docks and piers need ACC approval.
- Stormwater & impervious surfaces: Maximum built-upon area per homesite: 4,500 sq ft for lots 1-25 and 162-179; 6,000 sq ft for lots 26, 48-103, and 116-121. This includes structures, paving, gravel, etc., but not raised open wood decking or pool water surface. Runoff must drain into the permitted system.
- Parking & vehicles: Boats, trailers, RVs, campers, commercial vehicles, and inoperative/unlicensed vehicles may not be parked on a homesite for more than 24 hours unless inside a closed garage. A standard personal-use pickup is not considered commercial. Violators may be towed at owner's expense.
- Fences, signs & antennas: Fences and walls need ACC approval; chain link is not allowed. No dog pens or kennels. Playground equipment must be behind the dwelling. Signs are limited to a name/address sign and a temporary construction sign, both ACC-approved. Outside antennas and satellite dishes are prohibited except as allowed by ACC guidelines.
- Pets & nuisances: Dogs, cats, and other household pets are allowed if not kept for commercial purposes and in compliance with laws and association rules. No livestock or fowl. No noxious, offensive, or illegal activities; nothing that is a nuisance to the community.
