What Jackson Manor's governing documents say
Jackson Manor is a standard single-family home HOA in Wake Forest, NC, governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs). This document is the full rulebook for the community, binding all lot owners and their tenants, guests, and occupants. It covers property rights, assessments, architectural control, and use restrictions.
- What you own & maintain: You own your lot and the dwelling on it. The association owns and maintains the common areas (e.g., streets, stormwater facilities) and charges assessments to cover their upkeep, insurance, and other common expenses.
- Assessments & fees: Annual assessments are set by the board, with a cap that can rise up to 20% per year without a membership vote. Special assessments for capital improvements require a 2/3 vote of each membership class. At closing, a new buyer pays a working capital fund equal to two months of the regular annual assessment.
- Leasing & rentals: Leases must be in writing, for at least 180 days, and must include a provision that the tenant complies with the HOA rules. Copies of leases must be given to the association promptly after signing.
- Architectural review: Any exterior change—building, fence, landscaping, paint, etc.—requires written approval from the Architectural Control Committee (or the declarant during the development period). The committee can reject plans for aesthetic or other reasons, but approval cannot be unreasonably withheld.
- Parking & vehicles: Parking on streets is prohibited. Garages must be used for parking, not storage. Boats, trailers, campers, and trucks over 3/4 ton cannot be parked on the property except in an enclosed garage or designated areas. Inoperable vehicles cannot be regularly stored on lots or streets.
- Fines & enforcement: The board can fine for rule violations: $50 for the first, $100 for the second, and $100 per week for continuing violations. Unpaid fines become liens on the lot. The association can also suspend common-area use (but not ingress/egress or parking rights) for unpaid assessments or infractions.
- What this document doesn't cover: This excerpt does not include the full architectural guidelines, the bylaws, or any rules about pets, age restrictions, or rental caps—those may be in separate documents.
