What 1609 Searay Lane Townhome Owners Association, Inc.'s governing documents say
This is a townhome community in Wilmington, NC, governed by a homeowners association (HOA). You own your lot and the dwelling on it, and share ownership of common areas. The HOA maintains exterior elements (roof, front/side landscaping) and the stormwater system, while you are responsible for interior maintenance and repairs.
- What you own & maintain: You own your lot and the townhome on it. The HOA maintains the roof, front and side landscaping (including irrigation), and the stormwater drainage system. You are responsible for all interior maintenance and repairs, as well as doors and windows. Any damage you cause to other lots or common elements is your responsibility.
- Architectural review: No exterior changes (including painting, roofing, landscaping) may be made without prior written approval from the HOA or its Architectural Control Committee. The HOA must respond to a written request within 30 days; failure to respond constitutes approval.
- Use restrictions: Lots are for residential use only. No commercial business may be conducted. No temporary structures, trailers, or outbuildings may be used as residences. No inoperable vehicles, campers, trailers, or boats may remain on any lot. No vehicle repairs in driveways. No noxious or offensive activities. Trash cans must be removed from the street within 24 hours of pickup.
- Pets: Dogs, cats, or other household pets are allowed, but not for commercial purposes. Pets must be kept on a leash when outside the unit, and owners must clean up pet waste. Pets must not become a nuisance.
- Parking & vehicles: No inoperable vehicles or vehicles without current registration and insurance are permitted. No campers, trailers, motor homes, or similar vehicles may remain on any lot. No vehicle repairs in driveways. Parking must not impede access to other lots.
- Leasing & rentals: No lot may be leased unless all unpaid assessments are paid in full. The declaration does not specify a minimum lease term or other rental restrictions beyond that.
- Assessments & fees: Annual assessments are set by the HOA board based on an annual budget. Special assessments for capital improvements require a majority vote of lot owners. Unpaid assessments accrue interest and may become a lien on the lot. The HOA may also levy fines for rule violations.
- Party walls: The townhomes have double-wall construction with a 1-inch air gap between units. Repair and maintenance costs for party walls are shared proportionally by the owners who use the wall. Disputes are resolved by arbitration.
