What Churchill Estates's governing documents say
Churchill Estates is a single-family home subdivision in Wilmington, NC. This document is the Declaration of Restrictions and By-Laws for Section 1 (High Density), binding all lot owners and their successors. It establishes a homeowners association (Churchill Estates Homeowners Association) and sets rules for use, construction, and maintenance of lots.
- Permitted use & structures: Lots are for single-family residential use only. Only one detached single-family dwelling with a garage for no more than two cars is allowed. Garage-apartments, house trailers, mobile homes, modular homes, prefabricated homes, tents, and temporary structures are prohibited.
- Architectural review: Building plans must be approved by the developer (G & F Construction, Inc.) before construction. If no response is received within 20 days of submission, plans are deemed approved as long as they conform to other improvements in the subdivision.
- Setback requirements: Buildings must be at least 25 feet from the front street line, 10 feet from side lot lines (unless combining lots), and detached garages or storage buildings at least 5 feet from side or rear lines. Eaves overhanging up to 3 feet and uncovered stoops, patios, decks, or steps within setbacks are not violations.
- Pets: Only domesticated dogs, cats, or other household pets are allowed. They cannot be kept for commercial purposes or in numbers that become a nuisance.
- Vehicles & nuisances: No commercial or noxious activity is allowed. Inoperative junk cars and eyesores are prohibited and may be removed by the developer at the owner's expense. No signs except 'For Rent' or 'For Sale' signs not exceeding 6 square feet.
- Fences: Fences require developer approval of type, quality, height, and installation. No fence may be nearer the front lot line than the front corners of the house, except wrought iron, brick, or ornamental fences with written consent.
- Homeowners association & assessments: The Churchill Estates Homeowners Association is formed to maintain common areas (though Section 1 has no common areas). Lot owners automatically become members and are subject to dues and assessments as provided in the By-Laws.
