This document is the full declaration of covenants, conditions, and restrictions that run with the land.
- What you own & maintain: You own your lot and dwelling. The HOA maintains the exterior of each dwelling (paint, roof, gutters, siding) and all common areas, including the street, pond, and entrance signage. You are responsible for maintaining your limited common area (LCA) — the yard and parking area assigned to your lot — including mowing and keeping it clean.
- Leasing & rentals: You may lease your lot, but you must provide the tenant with a copy of this declaration and require them to abide by it as a condition of the lease.
- Pets: Only house pets are allowed; no farm animals or poultry. Pets must comply with city leash laws and cannot run freely through the neighborhood.
- Parking & vehicles: No parking on the cul-de-sac street except for emergencies. Parking is allowed in garages and designated parking slips in the common area. Inoperable vehicles, junk vehicles, unregistered/uninsured vehicles, and tractor-trailers are prohibited on any lot.
- Architectural & property standards: Only one residential dwelling per lot, attached by party walls (duplex style). Exteriors must be wood frame with vinyl, solid wood, or clay-brick siding; no concrete block, asbestos, stucco, or masonite. No chain-link fences; treated wood fences are allowed. No temporary structures, permanent clotheslines, or exposed fuel tanks. Garbage cans must be kept out of street view except on collection days.
- Assessments & fees: All lots are assessed equally. Annual assessments are set by the board and can increase up to 10% per year without member vote; larger increases require 2/3 approval. Special assessments may be levied for pond/stormwater repairs. A one-time working capital fee of $100 is due from the first purchaser at closing. Unpaid assessments bear 18% interest plus late fees and attorney's costs, and the HOA may file a lien and foreclose.
