Mulberry Place is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land and binds all lot owners. This document sets rules for residential use, construction standards, and property maintenance.
- Residential use only: All lots must be used for residential purposes only. Each lot may have one attached or detached single-family dwelling (max 2.5 stories) plus a one- or two-car garage.
- Minimum dwelling size: Dwellings must be at least 700 square feet (excluding porches, garages, carports), measured from exterior walls.
- Setback requirements: Buildings must be at least 20 feet from the front lot line, 15 feet from the rear, and 10% of the front width from side lot lines. Eaves overhanging up to 3 feet and chimneys are exempt.
- Architectural review: All building designs (including storage buildings, detached garages, additions) must be approved by the Developer or their agent. Approval is given or denied within 10 days of written request; if no response, approval is not required but design must harmonize with existing structures.
- Exterior materials & appearance: Dwellings must be wood, brick, brick veneer, concrete block with brick veneer, vinyl siding, composition board, or other approved synthetic material. Accessory structures must match the main dwelling's materials, color, and general appearance.
- Pets: Only household pets are allowed; they cannot be kept for commercial purposes. Pets must be kept inside, in an approved fenced area, or on a leash.
- Property maintenance & nuisances: Owners must keep lots neat and tidy, free of debris, junked cars, inoperative machinery, and noxious activities. Mechanical work on vehicles is only allowed in back yards.
- Fences: Fences cannot exceed 6 feet in height and must not extend nearer the street than the front setback line. All fences must be of the same design, height, type, and appearance as the first fence approved by the Developer. Corner lots require a rear fenced area for storing lawnmowers, bicycles, toys, grills, and stored materials.
