River Island is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. This document sets detailed rules for homeowners, covering minimum house sizes, architectural style, landscaping, pet limits, and an owners association with assessment powers.
- Residential use only: All lots are for single-family residential use only. No business, commercial, or professional activities are allowed.
- Minimum house size: One-story dwellings must have at least 2,400 sq ft of heated floor space; two-story at least 2,800 sq ft; three-story at least 3,000 sq ft. A two-car garage is required.
- Architectural & landscaping approval: All building plans, exterior materials, colors, and landscaping must be approved by the Developer (or later the homeowners association) to maintain a 'historic' look. Removal of trees 3" caliper or larger requires written approval.
- Pets: No more than 4 household pets per lot. Pets must be confined to a fenced area or on a leash when outside. Owners must clean up pet debris; violations may result in fines or special assessments.
- Parking & vehicles: Boats, trailers, campers, and recreational vehicles must be parked in the rear and screened from view. Up to 4 cars, minivans, or pickup trucks may park in the driveway. No inoperative vehicles or outdoor auto repairs visible from neighbors.
- Boat slips: Each lot is assigned one non-severable boat slip in the marina. Slips are for primary residents only; guests may use a slip no more than 7 days in any 30-day period. Slip assignments are first-come, first-served by the homeowners association.
- Homeowners association & assessments: The River Island Owners Association maintains common areas (streets, bridge, pier, boat slips, etc.) and can levy annual assessments (increased up to 10% per year without member vote) and special assessments (with 2/3 member vote). Unpaid assessments bear 14% interest and become a lien on the lot.
