What The South of Woodberry's governing documents say
The South of Woodberry, Section 3 is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Covenants, Conditions and Restrictions (CCRs) recorded in 1994. These rules run with the land and bind all current and future lot owners, focusing on residential use, minimum home sizes, construction standards, and property maintenance.
- Residential use & home size: All lots are for single-family residential use only. Minimum heated floor area: 2,000 sq ft for one-story homes, 2,200 sq ft for two-story homes (excluding porches, garages, etc.). An attached two-car garage with side entry is required.
- Construction & exterior standards: Exterior materials are limited to conventional frame, wood, brick, clay brick, stucco, or dry-laid stone; no concrete block, aluminum siding, or tar paper. Roofs must have a minimum 8/12 pitch and 25-year shadow line asphalt shingles in earth tones. All building and landscaping plans require developer approval before construction.
- Setbacks & tree preservation: No specific setback lines are set, but houses must be at least 30 ft from the front lot line and 10 ft from side lines (or county minimums). No tree over 10 inches in diameter at ground level may be cut without written consent; violation incurs a $300 per tree penalty.
- Fences, hedges & yards: Fences and hedges require written approval. Fences facing or parallel to the street must be stone, stucco, or wood. No fence or hedge is allowed nearer the front lot line than the rear of the house. Front yards must be sodded from street to house; corner lots require a 3-ft sod strip along the side street.
- Vehicles & parking: Each lot must have a paved driveway and off-street parking for at least two cars. No inoperable vehicles, vehicles without current registration/insurance, or vehicles larger than 3/4 ton (including buses, vans, school buses) are permitted. Boats must be stored in a building or back yard not visible from the street.
- Prohibited uses & nuisances: No yard sales, clotheslines visible from the street, noxious activities, or farm animals. Household pets are allowed subject to local ordinances. No temporary structures, mobile homes, travel trailers, or modular/prefabricated homes without developer consent.
- Maintenance obligations: Lot owners must keep lots mowed and clear of unsightly objects. The developer may enter and clean up at the owner's expense if not done. Owners are responsible for maintaining drainage easements and any buffer fences installed by the developer.
- Amendments & enforcement: The developer could amend restrictions until March 31, 1995. After that, amendments require a vote of two-thirds of lot owners. Covenants run for 20 years (until 2014) and automatically renew for 10-year periods unless a majority of owners vote to change them. Any owner or the developer may enforce the restrictions.
