What Sunset Reach's governing documents say
Sunset Reach is a planned community in Wrightsboro, NC, governed by a master association (Sunset Reach POA) and a sub-association (Sunset Towns POA) for the townhome section called Sunset Towns. This document is the supplemental declaration for Sunset Towns, creating a townhome community within the larger Sunset Reach development. It binds owners of townhouse lots, who are also members of the master association.
- What you own & maintain: You own your townhouse lot (land and dwelling). The Townhouse Association maintains the common area (landscaping, roads, parking, water/sewer lines, stormwater basins) and provides exterior maintenance of each townhouse (roof, gutters, exterior surfaces, decks, walks, driveway) except glass. You maintain items that service only your unit or are under your exclusive control.
- Assessments & fees: Annual and special assessments are levied uniformly per townhouse. A working capital assessment of $1,000 is due at initial sale. Late payments incur a late charge (set by board) and 18% annual interest. Unpaid assessments become a lien on the lot, subordinate to first mortgages.
- Leasing & rentals: No minimum lease term is stated in this document. Tenants may use common areas if assigned by owner, but the owner forfeits their own use rights during the tenancy.
- Pets: Up to two household pets (dogs, cats, etc.) per unit. Dogs must be 60 lbs or less at full growth; if only one dog, up to 90 lbs (or as approved by board). No commercial breeding or kennels.
- Parking & vehicles: No trailers, boats, RVs, or non-licensed vehicles allowed on lots or parking areas. No vehicle maintenance or repair on lots or parking areas.
- Party walls: Walls between townhouse units are party walls. Repair costs are shared proportionally by owners using the wall. Disputes go to arbitration.
- Stormwater management: The Townhouse Association is responsible for stormwater permit compliance. Maximum built-upon area per lot is limited (total 164,032 sq ft for the community). No alteration of drainage without state approval.
- What this document doesn't cover: This is a supplemental declaration for the Sunset Towns sub-community. It does not contain the full rules of the master Sunset Reach association (e.g., architectural review, sign restrictions, flag display rules are referenced but not detailed here). Age restrictions, rental caps, and amenity specifics are not addressed.
