This is an amendment to the Declaration of Condominium for Hunters Ridge, a condominium community in State College, PA. It sets new rules on leasing units, which apply to all current and future unit owners. The document does not cover other typical condo rules like pets, parking, or maintenance obligations.
- Leasing & rentals: No unit may be purchased as a rental. Units leased as of May 21, 2020 are grandfathered and may continue as rentals only while the current owner owns the unit; once sold or owner-occupied, the grandfathering ends. Leases must be for exactly 12 months (Board may extend up to 12 more months for good cause), be in writing, cover the entire unit, and require prior Board approval. Corporate apartments, home exchanges, Airbnb, and similar short-term rentals are prohibited. Leases may be terminated if the lessee violates rules.
- Lease approval process: The Executive Board must approve or disapprove a lease within 14 days of receiving a written copy. Renewals require the same approval process. In special hardship circumstances (e.g., estate settlement, health issues, temporary job assignment), owners may request Board permission for a lease of up to 12 months.
- Tenant obligations: Lessees must comply with the same Declaration, Bylaws, and rules as owners. The lessee will be given a copy of or access to those rules. The unit owner remains solely responsible for all assessments and fees; the lessee is not liable for the owner's failure to pay.
- Occupancy limits: Units may be occupied only as a residence for one family: either two related adults (by blood, marriage, or adoption) plus their children, or no more than two unrelated adults plus their children.
- What this document doesn't cover: This amendment only addresses leasing restrictions. It does not cover other common condominium rules such as pet limits, parking, architectural changes, maintenance responsibilities, or assessment amounts.
