This is a set of Bylaws (2017 amended version) for the Cottages at Innsbrooke Homeowners Association in Murfreesboro, Tennessee — a planned community of single-family attached homes (called Units) governed by an HOA. The rules apply to Unit Owners (homeowners), and for the age restriction and use rules, also to anyone who lives in or visits a Unit. The document is a complete rulebook that covers how the association is run, what homeowners must pay, and detailed lifestyle rules.
- Age restriction (55+): This is a 55+ active-adult community under the Housing for Older Persons Act. At least one occupant per Unit must be at least 55, and no occupant may be under 21. A maximum of two people may permanently occupy a Unit, though the Board may allow a third person (over 21) if needed to care for a primary occupant. Every two years (even-numbered years) a HUD/HOPA occupancy survey is conducted.
- Leasing & rentals: No Unit or any portion of a Unit may be rented. No homeowner or realtor may place any person in a Unit for any purpose without approval from a majority vote of the Board of Directors.
- Assessments & fees: Unit Owners pay a monthly charge set by the Board. The Board may increase fees up to 10% or $15 per month (whichever is less) without a 67% vote of Owners. Payment is due on the 1st; late after the 15th, with a $10 late fee. A $20 fee for returned checks. After two bad checks, only cash or money order accepted. A lien may be placed if payments are 3 months past due. A one-time $400 charge is paid by new homeowners to the master reserve.
- Pets: No more than two four-legged pets (cats and/or dogs) per Unit. No breeding or commercial keeping of animals. Dogs must be on a leash no longer than 6 feet when outside the Unit. Pets must not create a nuisance; if they do, the owner must remove the pet upon written notice from the Board. Pet waste must be cleaned up. Pets cannot be tied outside or left in a garage with the door open.
- Architectural review: Exterior modifications (painting, awnings, storm doors, satellite dishes, fences, etc.) require prior written approval from the Architectural Review Committee or Board. One for-sale sign (max 3 ft x 3 ft) is allowed in the front yard. Holiday decorations have specific time limits: Christmas decorations may go up 4 weeks before Dec 25 and must be down by Jan 10; other holidays allow 1 week before and 1 week after.
- Parking & vehicles: Residents must park in their garages; extra cars may park in the driveway clear of the sidewalk. No overnight street parking. No trailers, boats, RVs, or large commercial trucks may be parked on streets or parking slots (except for 24-hour loading/unloading). Such vehicles may be parked inside the closed garage. Speed limit is 20 mph.
- Use of common areas & clubhouse: The clubhouse is available to Unit Owners for private parties (with a $75 deposit, $25 refundable if cleaned) and community parties (free, open to all residents). Private parties are limited to 99 people, a 5-hour window, and no weddings, children's parties, or holiday events. Use is denied to Owners delinquent 30+ days. Common elements (walks, drives, yards, etc.) are maintained by the Association; residents must not obstruct or store personal property there.
