Avalon McKinney is a standard single-family HOA in Allen, TX. This document is a partial record containing selected amendments, guidelines, and fines — not the full CC&Rs. It supplements the community's rules on trash storage, flag display, meeting quorum, and enforcement fines.
- Trash & recycling storage: Trash and recycle receptacles may be placed curbside no earlier than 7pm the night before pickup. Homes with front-entry driveways must keep receptacles out of view (not in driveway). Homes with rear-entry driveways (alley) must keep receptacles at least 6 feet from the alley so they are not visible from the alley. Permanent receptacles holders require ACC approval.
- Flag display: Only the US flag, Texas state flag, and official US armed forces flags are permitted (max 3'x5'). One flag allowed on an attached pole (max 6' long, angled 30-45° down), and up to two flags on a freestanding pole (max 20' tall) with ACC approval. Freestanding poles must be setback at least half the front setback, full side/rear setback, and at least the pole's height from adjacent dwellings. Lighting must be ground-mounted, shielded, and not exceed 60W equivalent.
- Fines for violations: The Board imposes fines of $150 per month for each violation of the Declarations, CC&Rs, or rules that is not cured within the state-mandated notification period. Fines are enforced as special individual assessments.
- Meeting quorum (membership): An amendment reduces the quorum requirement progressively: if quorum (35% of votes) is not met at the first meeting, subsequent meetings require half the previous quorum, down to a minimum, as long as proper notice is given and all meetings occur within 60 days of the first meeting.
- Architectural review (ACC): The Architectural Control Committee sets guidelines (e.g., for trash receptacle holders and flagpole approval) and must approve any free-standing flagpole. The ACC may also publish and interpret architectural standards.
