Cottonwood Crossing is a single-family homeowner association (HOA) in Allen, TX. These documents are ancillary—they detail fees, collection procedures, and enforcement policies, but do not contain the full rulebook (Declaration). Homeowners and prospective buyers should be aware of specific transfer fees, late payment consequences, and fine amounts for rule violations.
- Fees for property transfer: When selling or refinancing, you must pay: Resale Certificate $375, Transfer Fee $250, Optional Inspection Fee $150, Operating Fee $250, and Reserve Capitalization $200 (applies only to builder-to-first-homeowner transfers). - Late payment & collection process: After a late payment notice, the Association may send a Notice of Default no sooner than 75 days past due. At 110 days, an attorney demand letter is sent; at 120 days, legal action (including lien filing) may begin. Owners can request a payment plan and a hearing before the Board.
- Suspension of privileges: If an owner is delinquent for 45 days or more, their right to use common facilities (and their family's) may be suspended until the account is current. Notice is sent by certified mail with a cure period.
- Violation fines & hearing: Fines escalate per violation: first $50, second $100, third $200, fourth $400, and can be imposed daily for continuing violations with no aggregate cap. The Board may double fines for repeat violations. Owners have the right to a hearing if requested within 30 days of a Notice of Violation.
- Common violations: Specific violations include: holiday decorations left more than 30 days after the holiday; storing boats, vehicles, trailers, ATVs, RVs, or oversized trucks; placing trash out only on designated pickup days; and littering in common areas.
- Architectural approval requirement: Any additions, improvements, or modifications require prior approval from the New Construction Committee (NCC). Failure to obtain approval is a violation, and corrective action (including removal at owner's expense) may be taken by the Association.
- Self-help (corrective action): If a violation persists after notice, the Association may hire contractors to correct it (e.g., remove an unapproved structure), and all costs are charged to the owner. This action requires prior written notice.
