What Hamrick Crossing's governing documents say
This is a partial document containing deed restrictions for Hamrick Crossing in Alvarado, TX, focused solely on drainage, floodplain, and sewage facility requirements. It does not establish a homeowners association or set typical community rules. These restrictions bind lot owners and their successors and are primarily engineering-related.
- Minimum floor elevation for low lots: Houses on lots lower than the road must have a finished floor elevation at least 18 inches above the adjacent grade to prevent storm water damage.
- Driveway culvert requirements: Driveway culverts must comply with Johnson County policies, be sized for a 5-year storm flow, and be at least 18 inches in diameter unless approved by the precinct commissioner or engineer. The top of the driveway must be 5 inches below the edge of the main road to allow overflow passage.
- Floodplain building restrictions: No houses may be built in the 100-year floodplain unless the finished floor is at least 3 feet above the floodplain elevation. No structures, dirt, rocks, gravel, or other materials are allowed within the floodway.
- Prohibition on obstructing drainage: Lot owners may not block the flow of water, construct improvements in drainage easements, or fill or obstruct the floodplain. Existing creeks and drainage channels must remain open and are to be maintained by adjacent lot owners. Johnson County has the right (but not the duty) to enter property and clear obstructions.
- Private sewage facility disclaimers: If private sewage facilities are used, Johnson County does not guarantee performance. Inspection indicates only minimum compliance. The owner must upgrade the system if it creates odors, unsanitary conditions, or fails to meet government regulations. Proper function depends on water usage and soil conditions.
- What this document doesn't cover: This document does not address HOA governance, assessments, architectural review, pets, leasing, parking, or any other typical community rules. It is limited to drainage, floodplain, and sewage infrastructure requirements.
