This document is a set of deed restrictions recorded against a single commercial lot (Lot 1R, Block 2, Rosewood Park Addition, Alvarado, TX). It binds all current and future owners and is enforceable by the beneficiary (Chicago Title Insurance Co.) and owners of the benefitted property (a Super 8 Motel property). The restrictions primarily control the type and quality of improvements — only retail or office use is permitted, construction must be brick, stone, or similar quality material, and no metal exteriors or warehouse/industrial use is allowed.
- Permitted uses: The property may only be used for retail or office purposes. Warehouse, industrial, or any other use is prohibited.
- Construction standards: All improvements must be of first quality and constructed of brick, stone, or similar quality material. Metal exteriors are not allowed.
- Duration & termination: The restrictions run for 20 years from recording (December 2009), automatically renewing for successive 10-year periods unless terminated earlier. Termination requires a written instrument signed by the beneficiary (so long as its deed of trust has not been released) and the owners of the benefitted property, or automatically upon full release of the deed of trust.
- Enforcement & remedies: The restrictions are covenants running with the land and are enforceable by the beneficiary and future owners of the benefitted property. Remedies include injunctive relief, damages for diminution in value, and actual attorneys' fees and expenses.
