Inniswood is a townhome community in Arlington, TX, where each owner holds fee simple title to a lot with a single-family townhouse and shares undivided ownership of common areas maintained by the Inniswood Owners Association. The association levies annual and special assessments to fund maintenance, insurance, and amenities like a swimming pool and landscaping. This document governs owner responsibilities, use restrictions, and association powers.
- What you own & maintain: You own your lot and townhouse (single-family unit). You are responsible for all interior and exterior maintenance, repair, and replacement of the townhouse, including fixtures, air conditioning, and utility lines on your lot. The association maintains all common area and landscape, except enclosed yard areas you may fence. If your negligence causes damage to common areas, you may be charged for repairs.
- Leasing & rentals: Any lease must be in writing and must bind the tenant to all governing documents; a violation of those documents by the tenant is a default under the lease. No minimum lease term or cap on the number of rentals is specified.
- Pets: A reasonable number of dogs, cats, or other household pets may be kept, provided they are not raised, bred, or maintained for commercial purposes.
- Parking & vehicles: Each lot includes a two-car carport for exclusive use. Storage of boats, trailers, campers, unused or inoperable vehicles, or other items deemed unsightly by the association is prohibited without permission.
- Architectural review: No exterior structure, addition, or alteration (including fences, walls, or changes) may be made without prior written approval from the Board of Directors or an Architectural Committee. Plans must be submitted; if no decision within 30 days, approval is deemed given. Once approved, the approval is irrevocable.
- Assessments & fees: Annual assessments are levied on each lot. The initial maximum is blank; after the first lot is sold, the board may increase assessments up to 120% of the prior year without a vote. Increases above 120% require approval of 2/3 of voting members. Special assessments for capital improvements also require 2/3 approval. Assessments are secured by a lien on the lot and are the personal obligation of the owner.
- Insurance: The association must carry property insurance on common areas (replacement cost) and liability insurance (minimum $1M per occurrence). Each owner must insure their townhouse to replacement cost and name the association as a co-payee. If an owner fails to maintain insurance, the association may buy coverage and charge the owner.
- Use restrictions: All lots are for residential use only. No commercial activity, no temporary structures (tents, trailers, etc.) as residences, no exterior antennas without approval, and no activities that create a nuisance or annoy neighbors. Clotheslines and storage must be screened. Visibility of fences and landscaping is controlled.
