What Timberlake Estates Home Owners Association's governing documents say
This is a Third Amendment to the Dedications and Restrictions for Timberlake Estates, a single-family home HOA in Azle, Texas. It updates the full set of rules for homeowners, covering property use, leasing, architectural control, assessments, and common areas. The document is the governing rulebook for owners in this community.
- Leasing & rentals: Renting is generally prohibited except for specific cases: active military or employer-directed moves, hardship exemptions, or if you owned and lived in the home for at least two years. All leases require Board approval, a lease approval form, and a provision binding the tenant to all HOA rules. Leases must be renewed annually and are subject to denial for cause.
- Architectural review: Any construction, fence, wall, or exterior modification requires written approval from the Architectural Committee. Exteriors must be at least 70% brick, stone, or masonry; composition asphalt roofs are not allowed; colors must be subdued and approved. Setbacks require 25 feet from streets, 6 feet from side property lines, and 20 feet from rear property lines.
- Property use & restrictions: Only one single-family residence per plot. No temporary structures, mobile homes, or tents. Livestock and poultry are prohibited. Boats, trailers, and campers must be stored out of view of the street or within 125 feet of the street if not screened. Fences over a certain height need written approval.
- Assessments & fees: Annual assessments are $120 per plot for owners who purchased on or before June 15, 2010, and $200 for those who purchased after that date. Payments can be made in one or two installments (due January 1 and June 1, delinquent on the 21st). The HOA may levy special assessments with two-thirds member approval. A transfer fee may be charged on sale or purchase.
- Common areas & amenities: The HOA maintains a community park, beach, and picnic areas. Use of common areas is limited to members in good standing. Children under 16 must be accompanied by an adult, and after 10 p.m. anyone under 21 must be with a resident at least 21. Swimming is only allowed in designated roped-off areas; no glass containers; no motorized vehicles on grassy areas.
- Enforcement & violations: The HOA can enforce rules through legal action, liens, and foreclosure for unpaid assessments. Members who violate rules may face hearings and fines. The HOA can enter vacant or abandoned property to cure violations and charge the owner. Members are jointly and severally liable for violations by tenants or guests.
- What this document doesn't cover: This is a Third Amendment that supersedes prior restrictions, but it does not include the full original declaration or any separate bylaws. It also does not specify details like pet policies, parking rules, or rental application fees beyond what is listed here.
