What Highland Meadows Homeowners's governing documents say
This document combines two separate governing instruments: a 1995 amendment to the Highland Meadows Homeowners Association's declaration (applying to a Benbrook, TX section) that adds specific roofing requirements, and the full Declaration of Covenants for Highland Meadows Estates (a standard single-family HOA in Keller, TX). The rules bind all lot owners in the respective communities. The text is OCR'd and may contain errors.
- Architectural review - roofing (amendment): New or replacement roofs must have a minimum 8/12 pitch, be fire-retardant wood shingles or composition dimensional shingles (not 3-tab) with a 30-year class A fire rating, and be Weatherwood color. Samples require written approval by the Architectural Control Committee; an approved shingle list may be updated.
- Assessments (declaration): The Association levies annual assessments (with a maximum that auto-increases 10% yearly), special assessments for capital improvements (needing 2/3 member vote), and default assessments. Assessments are a lien on the lot and a personal obligation of the owner. Declarant-owned lots pay 25% of the full rate; builder-owned lots pay 50%.
- Membership & voting (declaration): Each lot owner is a member of the Association with one vote per lot. Declarant has Class B membership with three votes per lot until Class A members own three times as many lots, then Declarant gets one vote per lot. Voting rights can be suspended for non-payment or rule infractions.
- Property rights in common areas (declaration): Members and residents have an easement to use the common property, subject to Association rules. The Association may regulate use, suspend rights for non-payment (up to 60 days for infractions), and charge fees for recreational facilities. Common property can be mortgaged or dedicated with member approval.
- What this document doesn't cover: This document is a partial fragment; it includes a specific roofing amendment and the full declaration but omits later amendments, bylaws, and rules (e.g., pet restrictions, leasing terms, parking). Readers should consult the complete set of governing documents.
