What Markum Ranch Estates's governing documents say
This is a set of individual Restrictive Covenant and Agreement documents between the builder (McBee Homes / Mearstone Properties) and the original owner of a specific lot in Markum Ranch Estates Add (Benbrook, TX). They are NOT the community's general Covenants, Conditions & Restrictions (CC&Rs) that govern the entire subdivision. Instead, they bind only the signing owner and builder, disclaiming implied warranties and mandating arbitration for disputes. They run with the land, so subsequent owners may also be bound.
- Warranty disclaimers: The builder makes no implied warranties (e.g., habitability, workmanlike construction). Only a written limited warranty applies. Any implied warranties that cannot be disclaimed are limited to two years from the date the builder conveyed the property.
- Dispute resolution: All disputes (contract, warranty, tort, statutory) must first go to mediation, and if not resolved, to binding arbitration under the Federal Arbitration Act, not in court. The arbitration is conducted by the American Arbitration Association or a substitute, with a single neutral arbitrator.
- Mold disclaimer and release: The builder disclaims all liability for mold, mildew, or other biological impurities. The owner releases the builder from any present or future claims related to mold, including personal injury and property damage, and agrees to waive subrogation rights.
- What this document doesn't cover: This document does not contain typical HOA rules such as pet limits, leasing restrictions, parking, architectural standards, or common area maintenance. For those, you must refer to the subdivision's separate, recorded Covenants, Conditions & Restrictions (CC&Rs).
