This document is a restrictive covenant and agreement between the original owner of Lot 3, Block 4 at Reata Place at Team Ranch and the builder (Sutter Homes/McBee Homes), not a community-wide rulebook. It binds the current and future owners of that specific lot and primarily addresses construction warranties, dispute resolution, and mold liability. It is NOT a full set of HOA rules or a declaration for the entire subdivision.
- Dispute resolution & arbitration: Any dispute between owner and builder must be resolved through binding arbitration, not court. The arbitration process is described, with the owner not required to pay unreasonable costs.
- Warranty limitations: Builder makes no implied warranties of habitability or fitness; any implied warranties are disclaimed or limited to two years from conveyance. Only the written limited warranty provided by builder applies.
- Mold & biological impurities: Builder disclaims all liability for mold, mildew, or other biological impurities. Owner releases builder from any claims related to mold, including personal injury or property damage, for $50 consideration.
- Manufacturer warranties: Builder assigns all manufacturer warranties on equipment (e.g., HVAC, appliances) to owner but makes no express or implied warranties on those items.
- What this document doesn't cover: This document does not contain community rules, HOA restrictions, pet policies, lease restrictions, architectural guidelines, or any ongoing residents' obligations. It is a one-time agreement between the original owner and builder.
