What Emily Estates's governing documents say
Emily Estates is a subdivision of single-family detached homes in Burleson, TX. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) sets rules that apply to every lot owner and run with the land. There is no homeowners association or mandatory assessments mentioned in this document; instead, the developer and individual owners have the right to enforce the restrictions.
- Architectural review: All construction, additions, fences, walls, and structures require prior written approval from the Declarant (or an Architectural Committee after 15 years or substantial development). Plans must show roof pitch, materials, weight, and grading.
- Minimum home size & materials: Single-story homes must have at least 1,200 sq ft of ground floor area (excluding porches, patios, garages, etc.). Two-story homes need at least 1,000 sq ft on the ground floor and 500 sq ft on the second floor. Exterior walls must be at least 80% masonry. All homes must have a two-car garage; garage conversions are allowed only if a detached garage is built first. No moved-on or prefab homes are permitted.
- Use restrictions: Each lot may have only one single-family residence and one incidental outbuilding. No business, religious, or commercial activity open to the public is allowed. No temporary structures, trailers, mobile homes, tents, or shacks may be used as residences.
- Parking & vehicles: Recreational vehicles, trucks, buses, boats, campers, and trailers must be parked or stored at least 50 feet behind the front building line, and not on the street or driveway until the home is occupied. Commercial equipment-vehicles may not be stored on the lot.
- Animals: Only dogs, cats, or other household pets may be kept. No animals or livestock may be raised, bred, or kept on any lot.
- Fences & signs: No fence, wall, hedge, or utility meter may be placed nearer to the street than the main residence, except decorative subdivision entry fences. Only one sign of up to 5 square feet advertising the lot for sale or rent is allowed.
- Lot maintenance: Owners must keep grass, weeds, and vegetation mowed on the front 1/3 of any unbuilt lot. If an owner fails to maintain the lot, the Declarant may mow and file a lien for the cost plus 15%.
- Amendment & duration: These covenants run for 20 years from recording (2002), automatically renewing for 10-year periods. During the first 20 years, amendment requires 90% of lot owners' approval; during renewal periods, 75% approval is needed during the last year. The Declarant may unilaterally amend for lots it still owns for the first 6 years.
