What The Escape's governing documents say
The Escape is a single-family homeowners association (HOA) in the Burleson/Grandview area of Texas. This document is a Covenant Enforcement and Fine Policy – an ancillary rulebook that explains how the HOA identifies, notifies, and penalizes violations of the main CC&Rs. As a homeowner, you are subject to this enforcement process, which includes fines, hearing rights, and possible lien placement.
- Violation & fine process: Violations are identified and addressed via a multi-step notice process: a courtesy notice (optional, 14-day cure), then a formal Notice of Violation (14-day cure), then a Notice of Fine if uncured. Some violations (e.g., safety threats, uncurable acts) may incur immediate fines without a cure period. Repeated violations within six months can reinstate previously waived fines and double the fine amount.
- Fine amounts: Single fines may not exceed $500 per violation. The standard fine structure is: $50 (first), $50 (second), $100 (third), $50 each subsequent day. For uncurable or health/safety violations: $100, $200, $400, then $50/day. Unapproved ACC modifications: $100, $200, $400, $50/day. There is no aggregate cap – fines can accrue daily until cured.
- Right to a hearing: After a Notice of Violation, you may request a hearing before the Board within 30 days (33 days from mailing). The Board must hold the hearing within 30 days of your request. You receive an evidence packet 10 days before. You can present your case, and the Board notifies you of its decision within 10 days of the hearing.
- Common violations: Exhibit 1 lists examples: failure to remove portable items within 24 hours, holiday decorations not removed within 30 days, storage of boats/trailers/RVs, trash cans left on non-pickup days, unapproved signs, exterior disrepair, overgrown landscaping, unauthorized modifications, vehicle violations (inoperable, missing plates), and more. This is not an exhaustive list.
- Corrective action (self-help): If a violation isn't cured within 14 days after a Notice of Violation, the HOA may, with Board approval, hire contractors to fix it. You receive prior written notice (Notice of Corrective Action) and an opportunity to cure. All costs are charged to your account and may become a lien.

It only describes enforcement procedures and fines.
