Creek Pointe Estates is a single-family home subdivision in Celina, TX (Collin County), governed by a homeowners association (the Creek Pointe Estates Residential Association). This declaration establishes the rules and restrictions that apply to every lot and owner, covering construction standards, property use, maintenance duties, and association assessments.
- Architectural review & construction standards: No building, fence, pool, or other improvement may be erected or altered without prior written approval from the Architectural Control Committee. Minimum air-conditioned floor area is 3,900 square feet. Construction must be completed within 18 months of commencement (with a possible 6-month extension). Roofing must not cause glare; wood roofing is prohibited. Driveways must be concrete or other approved material. Accessory buildings limited to 25% of main residence area and not in front yards.
- Assessments & fees: Each lot owner must pay annual Maintenance Assessments, plus possible Capital or Special Assessments. The first year's Maintenance Assessment per lot shall not exceed $150 per month unless approved by a majority of Class A and Class B members. Assessments are a continuing lien on the lot and a personal obligation of the owner at the time they become due.
- Landscaping & tree preservation: Front and side yards not enclosed by solid fencing must be fully landscaped and have an automatic sprinkler system. - Fences & walls: No wood fencing permitted. Maximum fence height is 8 feet from final grade (except perimeter fences). No chain link or wire fences without written approval. Fences, walls, and hedges are not allowed in the front yard setback. All service and sanitation facilities must be enclosed from street view.
- Signs & flags: No signs or flags may be displayed without written approval from the Architectural Control Committee, except one temporary real estate sign of no more than 10 square feet per lot for sale or rent.
- Maintenance obligations: Owners and occupants must keep lots and improvements in a well-maintained, clean condition, including mowing, tree pruning, trash removal, and fence/wall repair. If an owner fails to maintain, the association may enter and perform maintenance, assessing the cost as a Special Assessment.
