Enchanted Hills is a single-family residential subdivision in Colleyville, TX (Dalworthington Gardens). These Covenants, Conditions & Restrictions (CC&Rs) bind all lot owners to rules about land use, construction, and property maintenance. The document includes an amendment and a lot-specific exemption.
- Land use & building type: Each lot is restricted to one detached single-family residence. No duplexes, apartments, or multi-family structures. Residential use only — no business, commercial, or industrial activity. Minimum living area: 2,500 sq ft for Lots 1–9, 2,000 sq ft for Lots 10–12 (unless subdivided from Lot 12).
- Architectural review: All construction (new homes, additions, fences, walls) requires prior written approval from the Control Committee. Plans must include design, materials, and location. The Committee considers harmony of design with existing structures, quality of materials, and property values. Failure to act within 30 days deems plans approved.
- Exterior construction standards: Structures limited to 2 stories. Exterior walls must be 75% masonry/stone/stucco/brick on first floor unless variance approved. Roofs must be wood shingles, tile in earth tones, or 300 lb per square fiber fire-rated in earth tones (unless Committee approves otherwise). Minimum set-backs: 35 ft front, 15 ft side (25 ft on corner lot street side), 15 ft rear.
- Fences & walls: Fences and walls must be wood or masonry; chain-link may be allowed with Committee approval on side/rear lines not visible from street. Maximum height 6 ft unless Committee approves higher. No fence shall protrude beyond the front wall of the house or the side-yard building line on corner lots. Amendment exempts Lots 6 and 12 from location/height restrictions.
- Parking & vehicles: Regular parking and storage of vehicles is prohibited in streets, front yards, side yards, and rear yards unless enclosed by a 6-ft wooden or masonry fence. Ordinary passenger cars, trucks ≤ 3/4 ton, and motorcycles may be parked in garage, carport, driveway, or enclosed rear/side yard. Boats and motor homes only in enclosed rear/side yard. No inoperative, abandoned, or hazardous vehicles.
- Pets & animals: Only domestic household pets (dogs, cats, etc.) are allowed, and they may not be raised or bred for commercial purposes. Horses are permitted on Lots 6 and 12 (or subdivided lots from Lot 12 of 1 acre or more) for non-commercial use, not in front of the front building line or within 25 ft of adjacent lots.
- Antennas & signs: No radio or television antennae or towers are allowed. One sign (max 6 sq ft) advertising sale or rental is permitted. Temporary contractor signs and offices allowed with Committee approval. An exemption for Lot 12-R permits an amateur radio tower and antenna system, subject to interference mitigation conditions.
- Property maintenance: All lots and improvements must be kept safe, clean, neat, and orderly. Grass, weeds, and shrubs must be cut and trimmed regularly. No noxious, offensive, or hazardous activities. No dumping or accumulation of rubbish or garbage. Burning of refuse prohibited; must be stored in incinerators and removed regularly.
