What Clearhaven's governing documents say
Clearhaven is a standard single-family HOA in Collin County, TX, developed by Pulte Homes. This document is a Notice of Filing of Dedicatory Instruments that includes the association's Certificate of Formation and Bylaws, but does NOT contain the actual Declaration of Covenants, Conditions and Restrictions (the main rulebook). It describes how the HOA is organized and governed, not the day-to-day rules for homeowners.
- Membership & voting rights: All lot owners are mandatory members of the association. Each owner may vote in person, by proxy, or by absentee/electronic ballot. Proxies expire after 11 months unless otherwise specified. A quorum is 10% of total votes, but a special reduced quorum of at least 5 members applies to board elections when a quorum is not met.
- Board of directors composition & election: The board consists of 3, 5, or 7 directors. During the Development Period (up to 10 years after Declaration recording), Declarant (Pulte) appoints/removes all directors. After that, members elect directors for 1- or 2-year terms. At least all but one director must be residents of the community. Directors may be removed by a 40% vote of all members, or by the board for cause (e.g., 3 unexcused absences, 60+ days delinquent).
- Annual & special meetings: Annual meetings are held each year (first within one year of incorporation). Special meetings may be called by the president, the board, or upon petition by 10% of members. Written notice must be given 10–60 days before the meeting.
- Recount procedures for votes: A member may request a recount within 15 days of the vote/announcement, by paying an estimated cost. If the recount changes the election outcome, the association reimburses the cost. The recount must be performed by a qualified neutral third party.
