What Mountain Valley Lot's governing documents say
This is the Declaration of Covenants, Conditions, and Restrictions for Mountain Valley Addition, a single-family residential subdivision in Johnson County, Texas. These rules apply to all lot owners in the subdivision and regulate land use, building design, setbacks, and other property standards.
- Land use & residential requirements: All lots must be used only for private single-family residence purposes. No buildings other than private dwelling houses and customary outbuildings are allowed. No garage or outbuilding may be used as a residence except temporarily during construction (max one year) or for servants.
- Architectural review: All plans for any residence or structure must be approved in writing by N.P. Kendrick and E.M. Rogers or their designees before construction begins. Approval considers suitability, harmony with surroundings, and effect on adjacent property. Any addition or alteration also requires approval.
- Building materials & roof restrictions: At least 75% of exterior wall surfaces must be masonry or similar construction. Other materials need written approval. Composition roofs are prohibited; built-up roofs allowed only on flat surfaces or roofs with a pitch of 1.5 inches or less. Outbuildings (except greenhouses) must match the residence in style and materials.
- Setbacks & building lines: Residences must not be built closer to the street than the building lines shown on the plat. Enclosed porches, balconies, etc., may extend no more than 12 feet beyond the building line. Bay windows and similar projections may extend up to 4 feet. Steps may extend if no higher than first-floor level. Side setbacks from side lot lines must be at least 15 feet unless waived in writing.
- Outbuilding regulations: Outbuildings (including greenhouses) must be setback from streets as shown on the plat; the limit may be moved but no more than 15 feet nearer the street. Total width of outbuildings (other than greenhouses) cannot exceed 60 feet, and combined widths of all outbuildings (including greenhouses) cannot exceed 60% of the lot width (70% with written permission). Greenhouses max 20 feet wide. No outbuilding may exceed the main residence in height or stories.
- Minimum floor space: Every residence must have a minimum of 1,800 square feet of floor space, excluding porches and garages. This requirement may be reduced by 10% with written authorization from the designated approvers.
- Prohibited structures & uses: No billboards or advertising structures are allowed except a sign no larger than 5 square feet advertising the property for sale or rent. No fences, walls, or hedges may be erected on the front or exterior side of the building line except as specified. No radio aerial wires over unbuilt areas. No poultry or livestock. No trailers, campers, or boats may be parked in the open. No aboveground oil or fluid tanks. Fences on lots abutting the golf course must match the house material and architecture; chain-link or standard wood fences are prohibited near the golf course.
- Duration & amendment: The restrictions run for 40 years from the date of recording (July 1968) and automatically extend for successive 15-year periods. Owners of more than 50% of the front footage of all lots may terminate or modify restrictions by recording an agreement at least 5 years before the end of any period.
