What Northcrest HOA's governing documents say
This is a partial document — an amendment to the existing CC&Rs of Northcrest Homeowners Association, a single-family and townhome community in Dallas, TX. It modifies specific rules about home occupations, window AC units, garage sales, and property upkeep. It does not contain the full set of community rules.
- Home occupations: Home occupations are allowed but must be clearly subordinate to residential use, conducted entirely inside the primary structure, and cannot occupy more than 15% of the floor area. Only residents and their relatives by blood, marriage, or adoption may work there. Inventory and supplies are limited to 50% of the area. No exterior display, storage, or signage is permitted. Prohibited occupations include beauty shops, nail shops, and vehicle repair. Sales and services are by appointment only, with no more than two patrons on the premises at a time.
- Window air-conditioning units: New installations of window AC units are prohibited in any dwelling or other structure on a lot. Units already installed as of April 1, 2007, may remain.
- Garage sales: A maximum of four garage sales per lot per year is allowed. Each garage sale may last no more than three consecutive days, and at least 30 days must pass between separate sales.
- Unsightly or unkempt conditions: All outdoor portions of a lot (e.g., carport slab) must be kept clean and tidy at all times. Nothing may be stored or kept outside that, in the Board's determination, causes an unclean, unhealthy, or untidy condition or is obnoxious.
- Assessments and late fees: If any assessment remains unpaid after the delinquency date, the owner owes a late charge of 10% of the then-monthly assessment for each month (or portion thereof) the amount is overdue.
- Maintenance responsibilities (townhouses): Each townhouse owner is responsible for maintenance, repair, and upkeep of the interior of their townhouse, all appliances, fixtures, plumbing, heating, and air conditioning equipment, and any modifications approved by the Association. The owner must also maintain the portion of their lot not maintained by the Association.
- Lien and foreclosure: The Association has a lien on each lot for unpaid assessments, which may be foreclosed through judicial or non-judicial proceedings under Texas law. Each owner grants the Association a power of sale exercisable in accordance with the Texas Property Code.
- What this document doesn't cover: This is only the Fifth Amendment to the CC&Rs. It does not contain the full declaration, bylaws, rules, or policies of the Association. Topics such as pet restrictions, parking, architectural review, and the complete use restrictions are not included here.
