What Walnut Estates Property Owners Association's governing documents say
Walnut Estates is a single-family home HOA in Dallas, Texas, governed by a declaration of covenants, conditions, and restrictions. This document is a set of amendments (First and Second) that modify and restate the original 1993 declaration, so it is not the complete rulebook but rather the current governing rules for the community.
- Assessments & fees: The initial annual assessment is capped at $1,200 per lot, and annual increases are limited to 10% unless a majority of members approve. Special capital assessments require an 80% member vote before the developer's control ends, and the reserve fund cannot exceed 50% of the annual operating budget.
- Architectural review: An Architectural Control Committee (three members, elected by owners) must approve exterior lighting, antennas, satellite dishes, and other exterior changes. The committee can impose limits on things like patio sizes and may publish architectural standards.
- Maintenance & entry rights: The association can enter a lot's front and side yards (but not fenced/gated areas) to perform maintenance after written notice and a 30-day cure period. Owners are liable for the cost, which becomes a lien on the property.
- Common properties & amenities: Common properties include private drives, perimeter walls, landscaping, open spaces, and entry features. The association maintains these, and the developer must convey title to the association no later than when the developer no longer owns any lots.
- Voting & governance: The board has at least six directors elected annually by members. Bylaws require 70% member approval, and amendments to the declaration require 80% of member votes (excluding the developer). Quorum for certain actions is 60% of all votes.
- What this document doesn't cover: This is an amendment/restatement, not the full declaration. It does not include the complete original rules on pets, leasing, or other use restrictions, so those may be in the original 1993 declaration or other documents.
