It does not contain the full rules; it only modifies specific provisions about voting, assessments, and architectural restrictions. This amendment binds all lot owners and the homeowners association.
- Voting rights: The association has two classes of voting membership: Class A (lot owners other than developer) with one vote per lot, and Class B (developer) with one vote per lot owned. Class B membership ends when the developer owns 10 or fewer lots or by August 31, 1999, whichever comes first.
- Assessment structure for developer lots: Assessments are uniform per lot for Class A owners. For Class B owners (developer), a phased percentage applies: 25% of the annual assessment per lot from September 1, 1996 to August 31, 1997; 50% from September 1, 1997 to August 31, 1998; and likely 75% thereafter (text truncated). Before September 1, 1996, a fixed $50 fee per lot applied.
- Architectural restrictions - antennas and satellite dishes: No outside antennas or satellite dishes larger than 21 inches in diameter are allowed. Satellite dishes 21 inches or smaller may be permitted if not installed on the front of the house, not higher than the lowest roof line, and specifically approved by the Architectural Control Committee.
- Amendment approval requirement: This amendment was adopted with at least 70% approval from both Class A and Class B members, as required for amendments.
