What Lakeway Owners's governing documents say
Lakeway Owners Association is a homeowners association (HOA) for the Lakeway Harbor Subdivision in Smith County, Texas. These are the association's bylaws — they govern how the HOA operates, membership obligations, and meeting procedures. If you're buying a home here, these rules apply to you as a member.
- Dues & fees: Annual dues are due by August 31 each year; late fees can be assessed if payment is after October 31. The board can also charge a rental fee for lots occupied by someone other than the owner, regardless of a lease agreement.
- Pets: Up to four dogs are allowed, but they must be leashed when outside; loose dogs are not tolerated.
- Rentals: Owners who rent their property remain responsible for the lot, and the owner and occupant are both responsible for the rental fee, which is due by August 31.
- Architectural review: An Architectural Control Committee (ACC) exists to enforce the subdivision's restrictions; it reviews and reports to the board.
- Dispute resolution: Before taking legal action against the association, members must present complaints to the Dispute Resolution Committee or the board.
- Meetings & voting: The annual meeting is held on the third Saturday of May; each lot has one vote, regardless of number of lots owned; proxies are not allowed.
- Board elections: To run for the board, candidates must own property in the subdivision in fee simple, have all obligations paid in full, and be current on dues; husband and wife cannot both hold board seats simultaneously.
- What this document doesn't cover: The bylaws are the governance rules, not the full set of property restrictions. Detailed rules about what you can build, use, or do on your lot are in the separate Declaration of Covenants, Conditions, and Restrictions (CC&Rs), which this document references but does not reproduce.
