What Lucas Belmont Park's governing documents say
Lucas Belmont Park is a homeowners association (HOA) in Fairview, TX — the rules here apply to homeowners. This document is a partial, supplemental set of policies adopted in 2023 to comply with Texas legislative changes. It does not contain the full declaration, bylaws, or all restrictions; those are in other recorded documents. The policies cover hearing procedures, meeting notices, bidding, pool/security fencing, assessment collections, religious displays, and record-keeping.
- What this document covers: This document adds and amends specific procedures: covenant violation hearings, board meeting notices, service contract bidding ($50k+ threshold), pool fencing and security measures, assessment delinquency cure deadlines (45 days), religious display rights, and internet posting of governing documents.
- Covenant violation hearings: Homeowners can request a hearing within 30 days of a violation notice. The board must hold it within 30 days of the request. The association must provide evidence at least 10 days before; failure gives an automatic 15-day postponement. Audio recording is allowed.
- Board meeting notice requirements: Regular meetings: notice by mail 10-60 days ahead, or posted/emailed at least 144 hours (6 days) before. Special meetings: posted/emailed at least 72 hours before. Actions taken outside a meeting (e.g., by email vote) must be summarized at the next open meeting. Certain votes (fines, assessment increases, budget approval, etc.) must happen in an open meeting.
- Service contract bidding: For contracts over $50,000, the association must solicit bids or proposals. It may accept a single bid if at least three vendors were asked and given at least 7 days to respond.
- Pool and security fencing: Pool enclosures must be black, transparent mesh with metal frames, max 6 ft height, and conform to safety codes — the association cannot deny if those standards are met. Security fencing in front yards must be ornamental wrought iron or metal (black), with specific picket/rail/post dimensions, no slats or solid material, height 48-60 inches.
- Delinquent assessment collections: Before reporting to credit agencies or hiring a collector, the association must give a 45-day cure notice via certified mail. It must offer a payment plan. Credit reporting requires separate 30-business-day notice. Fees charged must be reasonable.
- Religious displays: Homeowners may display religious items motivated by sincere belief, but not on association/common property, not violating building lines/rights-of-way, and not containing offensive content beyond religious speech. The association may remove violations.
- What this document doesn't cover: This is a partial document. It does not include the full declaration of covenants, bylaws, architectural standards, parking rules, pet restrictions, or other common HOA rules. Those are found in the recorded declaration and other governing documents.
