Devonshire 2D is a subdivision of single-family homes in Forney, TX. The documents here are individual lot 'Declarations of Restrictive Covenants' recorded by the builder (Perry Homes) that run with each property for 15 years. They do not establish a homeowners association or neighbor rules — they mainly govern dispute resolution and limit legal remedies between the current and future owners and the builder.
- Dispute resolution & arbitration: Any dispute arising from the purchase contract, construction, or property must first go through mediation, then binding arbitration (under the Federal Arbitration Act or state equivalent). You waive your right to a jury trial in any lawsuit, and if you file a lawsuit in violation, you must reimburse the other party's costs.
- Limitations on claims: Any lawsuit must be filed within 2 years from the closing date (presumed accrual date). Damages are capped at what the Texas Residential Construction Liability Act allows, and you waive any indirect, consequential, or punitive damages (including lost profits, mental anguish, and market fluctuation losses).
- Seller's remedies (rescission & repurchase): In disputes after closing, the seller (Perry Homes) can choose to rescind the sale: you must deed the property back, and the seller refunds the purchase price plus some costs. Alternatively, if construction defects exceed 20% of the home's value, the seller may repurchase the property at the original price plus closing costs, attorney's fees, and moving expenses.
- Term & duration: These covenants last for 15 years from the closing date. After that, they automatically expire except for arbitration or legal proceedings that started before expiration.
- What this document doesn't cover: This is a restrictive covenant focused solely on dispute procedures and remedies. It does not set up a homeowners association, impose architectural standards, regulate pets, leasing, parking, or any other community rules.
