What Devonshire Village 4C's governing documents say
This is a lot-specific Declaration of Restrictive Covenants for a single-family home in the Devonshire Village 4C subdivision. It is not a full HOA rulebook; instead, it binds the property owner and all future owners to mandatory arbitration, jury trial waiver, and other legal provisions for 15 years from the closing date. The document primarily governs disputes between the buyer and the builder (Perry Homes).
- Dispute resolution (arbitration & mediation): All disputes must first go to mediation; if not resolved, they go to binding arbitration under the AAA. The homeowner pays no more than $375 to initiate arbitration and no more than $750 total for a single arbitrator; the seller pays the rest.
- Jury trial waiver: If arbitration is not enforced, the parties waive their right to a jury trial. Any court proceedings will be decided by a judge alone.
- Limitation of claims: Any legal action against the seller must be brought within two years of closing. Damages are strictly limited to those allowed under the Texas Residential Construction Liability Act; no consequential, punitive, or mental anguish damages.
- Seller's special remedies: The seller (Perry Homes) may elect to rescind the sale (refund purchase price plus expenses) or repurchase the property if repair costs for construction defects exceed 20% of the property's value. The buyer cannot demand these remedies.
- What this document doesn't cover: This declaration does not contain typical HOA rules such as architectural controls, pet limits, parking, leasing restrictions, or maintenance obligations. Those rules would be found in separate community-wide declarations or by-laws.
