Emerald Park is a single-family residential subdivision in Fort Worth, Texas, subject to a declaration of covenants, conditions, and restrictions (CC&Rs) that run with the land. The rules apply to all owners and residents and cover building design, fencing, pets, and property use. This document combines the original 2003 building and use restrictions with a 2016 mailbox amendment.
- Building & architectural review: Each lot may have one private dwelling, which must meet city minimum floor area requirements and have a roof pitch of at least 6 inches per 12 inches. Plans must be submitted for approval; if no decision is made within 30 days, approval is deemed granted.
- Fencing: Fences cannot be placed nearer to the street than the front line of the improvement, and may not exceed 8 feet in height (or city limit if lower). Along boundaries with city parks, metal or wrought iron fencing is required.
- Pets: Domestic animals are allowed only for companionship, not for any commercial purpose, and the keeping of horses, cows, hogs, sheep, goats, fowl, ducks, chickens, or turkeys is prohibited.
- Use restrictions: No noxious or offensive activity, no oil/gas/mining operations, and no temporary structures (including trailers, tents, or outbuildings) may be used as residences. Garbage must be kept in sanitary containers, and no lot may be used as a dumping ground.
- Mailboxes: Mailboxes must meet USPS requirements and conform to the community's standard design for the portion of the property where they are located. Owners are responsible for keys, locks, and interior condition of their mailbox; the association maintains shared pedestal mailboxes, which must be kept in their original location.
- Duration & amendment: The restrictions remain in effect for successive 10-year periods unless a majority of owners vote to change them. The developer had the right to amend or revise restrictions while owning lots, but after January 1, 2013, approval of plans is only required if owners appoint a representative.
