This is a supplemental declaration for a single-family residential HOA in Silver Ridge, a master-planned community in Fort Worth, TX. It adds 58 new lots (the '2017 Annexed Property') to the existing Silver Ridge Phase Two Residential Association, binding those lot owners to the association's rules, assessments, and architectural standards. If you're buying or living in this new section, these rules apply to you.
- Assessments & fees: Each lot pays a flat annual assessment of $300, starting at the lot's 'Commencement Date' (first sale to a third party) but no later than 18 months after the developer conveys the lot. Until then, a vacant lot assessment of $35 per year applies. Annual increases are capped at 10% per year without a 67% vote of owners.
- Architectural review: All exterior changes require approval from the Architectural Review Committee (ARC). Specific standards include: homes must be 1,500–3,200 sq ft of enclosed area; front elevations must be at least 60% brick or masonry veneer (100% on corner lots); roofs must be composition shingle (minimum 220 lbs) with a 6/12 pitch; driveways must be paved and 16–20 feet wide at the street; and front yards must have two shade trees within 90 days of occupancy.
- Fences & landscaping: Fences cannot be built in violation of local laws or plat provisions. Landscaping must be completed within 90 days of occupancy, with front yards sodded and rear/side yards seeded or sodded. Paving within 20 feet of the street right-of-way is prohibited except for driveways and walkways.
- Signs, flags & religious displays: Political signs are allowed from 90 days before an election to 10 days after, with limits (one per candidate/ballot item, ground-mounted, max 4x6 feet). Flags are permitted with restrictions: freestanding flagpoles max 20 feet, attached flagpoles max 6 feet, and flags must be maintained. Religious items may be displayed on the entry door if under 25 square inches and not extending past the door frame.
- Solar panels & rain barrels: Solar energy devices are allowed but must not reduce energy production by more than 10% compared to an optimal location, and require ARC approval. Rain barrels and rainwater harvesting systems are allowed but cannot be in the front yard between the dwelling and the street, must match the house color, and must be approved by the ARC.
- Mineral rights: The developer reserves all oil, gas, and mineral rights under the property, but waives surface use for exploration. Drilling is prohibited on the lots, though the developer may drill from adjacent land as long as it doesn't interfere with surface support.
- Lien & foreclosure: The association has a lien on each lot for unpaid assessments, which can be foreclosed. However, foreclosure is prohibited for debts consisting solely of fines or attorney's fees. Owners have a right to a payment plan (minimum 18 months) and must receive 30 days' notice before collection referral.
