- Dispute resolution: mediation & arbitration: Any construction-related dispute between the owner and builder (defects, warranties, personal injury, property damage) must first go to mediation and then to binding arbitration, not court. The arbitrator can award fees and expenses.
- Warranties: The builder disclaims all implied warranties, including habitability and good workmanship, to the fullest extent the law allows; if the law does not permit the disclaimer, implied warranties are limited to two years from the date of conveyance.
