Diamond Point Estates is a standard single-family homeowners association (HOA) in Denton, TX. The documents here are administrative policies (records retention, enforcement and fines, collection and payment plans) that supplement the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs). These rules bind all property owners.
- Fine schedule for violations: For curable violations: $100 for first demand letter, $150 for second and subsequent notices. For uncurable violations or those threatening health/safety: $250 fine. Fines may be adjusted case-by-case by the Board.
- Late fees and interest on delinquent assessments: Assessments are due semi-annually (Feb 1 and Jul 1). If not paid within 30 days, a $25 late charge applies per month and interest accrues at 18% per annum from the due date.
- Payment plans for delinquent amounts: Owners may request a payment plan of 3 to 6 months for delinquent assessments. No additional monetary penalties accrue during the plan, but interest may continue. Plans are void upon default; re-entry limited to once per 12 months and not allowed if defaulted within previous 2 years.
- Records retention periods: Financial and account records retained 5–7 years; contracts 4 years after termination; minutes 7 years; tax returns 7 years; permanent retention for formation documents, CC&Rs, insurance policies, legal opinions, and suit files.
