What Preston Glen III's governing documents say
Preston Glen Addition Phase II-B is a single-family residential subdivision in Frisco, TX, governed by a set of restrictive covenants that run with the land for 25 years from 1997. These covenants bind all lot owners and set minimum construction standards, use limitations, and maintenance obligations. The document is a standard HOA-style declaration, though it does not create an active homeowners' association with dues or a board; enforcement is by individual lot owners or the developer.
- Use restrictions: All lots are designated as residential only. No noxious or offensive trade, activity, or nuisance is permitted. No temporary structures, trailers, modular homes, or tents may be placed, except for a sales or construction trailer during development.
- Construction standards: Dwellings must have at least 65% masonry (stone, brick, or stucco) on the first story, a minimum 5/12 roof pitch, and a living area of at least 1,000 sq ft (first floor minimum 700 sq ft for two-story). Garage space for two cars is required, and garages must remain functional (no conversion to living space). All driveways must be reinforced concrete. Exterior completion is required before occupancy; construction must be finished within eight months of starting.
- Exterior equipment & utilities: No window or wall-type air conditioners/water coolers are allowed. No visible outside antennas or aerials; satellite dishes may be permitted only if not visible from any street, alley, or adjoining lot and not above fence height. No individual water supply system is permitted; all homes must connect to the city sewerage system.
- Fences & setbacks: Boundary fences must be wooden stockade, masonry, hedge, or substantially constructed wood. No fence may be built closer to the front lot line than the building line. Fences used to shield satellite dishes may not exceed eight feet in height.
- Easements & maintenance access: A nonexclusive easement exists for owners to access a 4-foot strip on the adjoining lot solely to maintain a wall or structure on the property line. Utility easements are reserved for public utilities.
- Signs & model homes: Signs are limited to real estate signs (e.g., one in front and one in back yard). The developer may operate model homes, sales offices, and construction trailers during the sales period.
- What this document doesn't cover: This document does not address association fees, pet restrictions, leasing limits, parking rules, or an architectural review committee. It is a partial governing document; additional declarations or bylaws may exist for the community.
