What Tuscany Square's governing documents say
This is a supplemental set of guidelines for the Townhomes of Tuscany Square HOA, a townhome community in Frisco, TX. It is not the full set of governing documents; it adds specific rules on religious displays, flags, solar panels, rain barrels, records access, payment plans, and waivers. These rules bind homeowners, and renters should also be aware of them.
- Religious displays: Religious items are allowed only on your entry door or door frame, must not exceed 25 square inches, and cannot contain offensive language or graphics or pose a safety hazard.
- Flags and flagpoles: Only U.S., Texas, and military flags are allowed. Attached flagpoles may not exceed 6 feet in length; freestanding ones max 20 feet in height, require prior approval, and must be located per guidelines. Flags must be kept in good condition.
- Solar panels: Solar panels require prior written approval from the Architectural Control Committee. They are only allowed in your fenced yard or patio, must not extend beyond the roofline or be taller than the fence, and must be screened from neighbors.
- Rain barrels: Rain barrels are allowed only with approval, must be placed in the rear yard (not front), only one per downspout, and must be enclosed to avoid mosquitoes and screened visually.
- Records access and costs: Owners may request Association records; copying costs 10 cents per standard page, $1 per CD, and there may be labor and programmer fees. Some records (violation histories, personal financial info) are confidential.
- Payment plans: The Association offers payment plans for delinquent assessments, with a minimum term of 3 months, fees to set up and administer, and clear default criteria. Settlements may be considered at foreclosure stage.
- Waivers: The Board may waive late fees and interest in extenuating circumstances, but waivers are not guaranteed and may come with conditions, including a payment plan if eligible.
