Beaver Creek Estates is a single-family home subdivision in Glenn Heights, TX, governed by a homeowners association. These covenants apply to all lot owners and their heirs or assigns, and they cover building standards, land use, and an annual association fee.
- Term & amendments: The covenants run with the land for 25 years from 1978, then automatically renew for successive 5-year periods unless a majority of lot owners vote to amend or abolish them. A 1983 amendment deleted the developer's unilateral right to change the restrictions.
- Land use & building standards: All lots are for residential use only, with one single-family house per lot built of new materials. The main dwelling must have at least 1,800 square feet of floor area (excluding porches and outbuildings), and exterior walls must be at least 70% brick or masonry.
- Architectural review: Construction plans, specifications, and a plot plan must be submitted to and approved in writing by the Architectural Control Committee before any building, including garages, is erected or altered. Approval is automatic if the committee fails to act within 21 days of submission.
- Nuisances & construction timeline: No used buildings, trailers, buses, tents, abandoned vehicles, or other nuisances are allowed. New houses must be completed within 160 days of starting construction.
- Garages & setbacks: All garages must be at least two-car size, and carports must match garage capacity with fronts closed by the same materials as the main dwelling. Structures must be set back 60 feet from Beaver Creek Road, 50 feet from other streets, and 20 feet from side lot lines. Fences in front of the front building line must be open.
- Animals: No animals, livestock, or poultry may be raised or bred for commercial purposes. However, two horses or one calf per lot may be kept for pleasure (on larger lots, two horses or one calf per acre), and they must be fenced behind the front building line. Dogs, cats, and other household pets are allowed if not kept for commercial purposes.
- Signs: No signs are allowed visible from public view except one sign per lot, not exceeding six square feet, advertising the property for sale or rent. Subdivision signs may be larger.
- Association & annual fee: Lot owners are organized into an association that maintains public areas, entrance gates, walls, street lights, signs, roads, and lake front easement property. The association charges an annual fee of $35 per lot, which can be changed by a 2/3 vote of owners. The fee is secured by a lien, and the association may file a lien if the fee is 90 days past due.
