What Duplex Owners's governing documents say
This is a townhome (duplex) community in Arlington, TX, where each owner holds fee simple title to their dwelling unit and the land beneath it. The community is governed by restrictive covenants that run with the land, with shared responsibilities for party walls and separating fences. There is no homeowners association; enforcement is by individual owners.
- What you own & maintain: You own your dwelling unit and the tract of land it sits on. You are responsible for maintaining the exterior walls of your unit and the roof over your unit at your own cost. Party walls and separating fences are shared with neighbors.
- Party walls & fences: The costs of maintaining and repairing party walls (walls between units) and separating fences are split equally between adjoining owners. Neither owner may alter or change a party wall or fence, and each has a perpetual easement for its support. Damage from negligence is the negligent owner's full cost. Disputes are resolved by arbitration.
- Building & architectural rules: Only new single-family duplex/townhome structures, max two stories, with at least 1,600 or 1,800 sq ft per building (depending on lot) and 75% masonry exterior are allowed. All construction requires prior written approval from the Architectural Control Committee, which must respond within 30 days. No used structures, temporary dwellings, or unfinished occupation.
- Parking & vehicles: No boats, campers, or motorhomes may be regularly stored in front or side yards. Trucks over 3/4 ton cannot park overnight on streets, driveways, or lots. No vehicles transporting flammable/explosive cargo are allowed at any time.
- Pets: Only usual and ordinary household pets are permitted. No livestock, poultry, small animals, or wild animals may be kept on the premises.
- Use restrictions: No noxious or offensive activity, no business or hotel use. Trash must be collected in covered containers; burning trash is prohibited. Lawns must be kept mowed. Antennas or towers for radio operation are not allowed. One 3x5 ft sign for sale or rent is permitted.
- Enforcement & amendments: Covenants run with the land until 2005/2006 (depending on section), then auto-renew for 10 years unless 2/3 of owners vote to change. Any owner can enforce by lawsuit; successful parties can recover attorney fees. Amendments before 50% lots sold require developer's approval; after that, unanimous owner consent is needed.
