- Architectural review & approvals: All improvements, including construction, alterations, landscaping, and signs, require prior written approval from an Architectural Controller. No verbal approval is valid. The Controller may charge reasonable consultant fees for review. Declarant-approved improvements are deemed approved.
- Permitted & prohibited uses: Permitted uses include financial institutions, service shops, offices, restaurants, and retail (with approval). Prohibited uses are listed in Exhibit B and include sexually-oriented businesses, bars, pawn shops, vehicle repair, kennels, mini-warehouses, and any use that creates nuisance or violates law. Variance is possible with written approval.
- Maintenance standards: Owners must maintain all improvements at a level commensurate with surrounding properties, including repair, replacement, and repainting. Failure to maintain allows the Architectural Controller to perform work at owner's expense after notice (or immediately in emergencies).
- Landscaping requirements: Detailed landscaping standards apply, including perimeter and interior parking lot landscaping, screening of ground-mounted equipment, and irrigation. Owners must enter into a service agreement with the Heartland HOA for landscape maintenance, binding on successors.
- Enforcement & liens: The Architectural Controller and Declarant may enforce covenants through self-help, damages, and liens. Unpaid assessments or charges are secured by a lien on the property, enforceable by foreclosure. The lien is subordinate to first mortgages from unrelated lenders.
