What Caddo Peak Estates's governing documents say
Caddo Peak Estates, Phase II is a standard single-family home subdivision in Joshua, TX, governed by a Declaration of Covenants, Conditions and Restrictions recorded in 1978. These rules apply to all lot owners and residents, covering what you can build, landscape, keep on your property, and how you use your home.
- What you can build: Only single-family dwellings up to two stories, with a private garage for no more than three cars, are allowed. Minimum ground floor area is 1,000 sq ft (1,500 sq ft for two-story). All structures must be approved in writing by the developer (or their delegate) before construction.
- Setbacks & lot lines: Buildings must be at least 30 feet from the front property line, 15 feet from any side street line, and 5 feet from interior lot lines. Detached garages and outbuildings may be closer to interior lines.
- Architectural & exterior standards: All houses must have a masonry, brick, or stone front. Garages, carports, and animal shelters must be architecturally harmonious with the main dwelling and of substantial quality, costing about half per square foot of the main dwelling (excluding porches). Fencing must be first quality and approved by the developer.
- Pets & livestock: Household pets are allowed, but no livestock or poultry except on lots of 1+ contiguous acres, where you may keep one sheep, goat, cow, or horse for non-commercial use. Adequate fencing and screening required.
- Nuisances & uses: No noxious or offensive trade or activity. No trailers, basements, tents, shacks, or outbuildings may be used as residences. Only one single-family dwelling per lot (plus a possible servant's house). Signs limited to one professional sign (1 sq ft) and one sale/rent sign (5 sq ft).
- Sight lines & landscaping: No fence, wall, hedge, or shrub between 2 and 6 feet high within the triangular sight area at street intersections (25 feet from street lines). Trees within that area must have foliage kept high enough to avoid obstruction.
- Developer's reserved powers: The developer (and assigns) retains the right to waive, vary, or amend restrictions for individual lots to relieve hardship or permit good planning, and to replat property or change street locations before public use. The developer's interpretation of the covenants is binding, and they may appoint a committee to exercise these powers.
