This document is a Declaration of Land Use Restrictions recorded in 2023 that burdens a 54.5-acre tract (the Restricted Property) for the benefit of two acres (the Beneficial Property, which includes Lot 9, Block 1 of Sundance). It is not a full community rulebook—it applies only to the specific Restricted Property and runs with the land. Current and prospective owners of that parcel should read this carefully; others may find it irrelevant.
- Permitted dwellings: Only site-built single-family detached homes are allowed. Mobile homes, modular homes, recreational vehicles, and temporary dwellings are prohibited. Structures must be built of new materials and meet all applicable municipal codes.
- Ancillary structures & outbuildings: No temporary dwelling, shop, trailer, modular building, or mobile home may be used as a dwelling. Outbuildings (e.g., barns, garages) are not specifically prohibited but cannot be occupied as a residence. No temporary structures such as tents or shacks may be used as a dwelling.
- Vehicles & parking: Abandoned, dilapidated, or inoperable vehicles are prohibited and may be towed. Any vehicle without a current title registration for 30 days is considered abandoned. Trucks over one ton cannot be parked or stored. Vehicles carrying flammable/explosive cargo are forbidden. Construction vehicles temporarily parked are exempt.
- Animals & livestock: No animals, livestock, or poultry may be raised, bred, or kept except for dogs, cats, or other household pets (excluding swine). Maximum of 4 pets, plus up to 5 non-rooster chickens, and one horse or cow. Pets must be confined in a fence or inside the house. No commercial animal keeping, no nuisance barking. The property cannot be used as a feedlot or for food production.
- Nuisances & prohibited activities: No noxious or offensive activity, dumping of rubbish, trash, or waste. Construction debris may be stored only during ongoing construction. The property cannot be used in any way that creates a nuisance or danger to the neighborhood.
- Oil & gas restrictions: No oil, gas, or mineral drilling, mining, or exploration on the surface. No wells, tanks, tunnels, or drilling structures are permitted.
- Duration & amendment: The restrictions run with the land for 25 years from the recording date (September 2023) and automatically renew for successive 25‑year periods unless the Beneficial Property owners record a change.
- Enforcement: The owner of the Beneficial Property (or heirs, successors) may enforce these covenants through legal action to prevent violations or recover damages. Failure to enforce does not waive future enforcement rights.
