Country Vista Estates is a subdivision of single-family detached home lots in Johnson County, Texas, governed by a set of restrictive covenants recorded by the developer. Buyers and residents are bound by rules covering construction standards, maintenance, and land use. A homeowners association may be formed once 80% of homes are occupied, but until then the developer's Architectural Control Committee largely enforces the rules.
- Wastewater fees: Each lot owner must pay a monthly $25 fee to the developer for use of the wastewater treatment plant, due on the first of the month starting when the home is substantially completed. Fees may change after 1999 based on operating costs, and the developer has a lien for unpaid fees (subordinate to a first mortgage).
- Homes & construction: Only one single-family detached dwelling per lot, must be completed within six months of starting construction. Minimum living area: 1,400 sq ft on the ground floor for multi-story homes, 2,200 sq ft overall for single-story. Exterior walls must be at least 80% masonry, stone, stucco, brick, or glass (waivable by Architectural Control Committee). Roof minimum pitch 8/12, composition shingles of at least 300 weight. No temporary structures, mobile homes, or outbuildings besides permanent detached garages.
- Pets & livestock: No livestock or animals other than usual household pets. No commercial breeding. Maximum three fully grown pets per lot, must be kept within the lot perimeter by fencing or on a leash.
- Parking & vehicles: No trucks, boats, trailers, or vehicles larger than one ton, and no unlicensed or non-operating vehicles may be parked in the street, along the curb, or in driveways closer to the street than the front building line. One boat or one motor home/travel trailer may be regularly stored behind a stockade fence. Garage openings must be at side or rear and accommodate at least two cars, unless a variance is granted.
- Architectural review: All construction, alterations, and additions require prior written approval of the Architectural Control Committee (composed of developer or its representative). Plans must be submitted; if no decision within 45 days, approval is deemed granted. Committee may waive certain restrictions (e.g., masonry percentage, roof type) on a per-lot basis.
- Landscaping & maintenance: Front yards must be hydromulched or sodded within 45 days of house completion. Grass, weeds, and vegetation must be kept mowed; failure allows the Architectural Control Committee to mow at owner's expense (lienable). Bar ditches must be maintained as front yard with ground cover.
- Homeowners association (future): When 80% of constructed homes are occupied, homeowners shall form a homeowners association to maintain certain common areas. Until then, the developer's covenants and committee control apply.
- Use restrictions: No trade or business, no signs (except one 6'x10' sale or rental sign), no blocking water flow or building in floodplains without minimum floor elevation, no earth-sheltered or underground structures without committee approval, no outdoor lighting inconsistent with dwelling style, no mercury lights, all mailboxes must be brick matching the residence and located curbside.
